FarmIQ AI Services Terms

1. Overview of FarmIQ AI Services

FarmIQ is an artificial intelligence-powered assistant integrated into the FarmSentry platform. It provides information, suggestions, and responses related to farm management using machine learning models, retrieval-augmented generation (RAG), and natural language processing technologies.

The FarmIQ AI Services include:

• AI Chat Assistant: Conversational interface for farm-related queries and guidance.
• Document Processing: Upload and processing of user documents (PDF, DOCX, TXT) for knowledge retrieval.
• Knowledge Retrieval: Semantic search across help guides, curated knowledge packs, and user-uploaded documents.
• Farm Context Integration: AI access to your farm data (with your permission) to provide personalized responses.

By using any FarmIQ AI feature, you agree to these AI Services Terms in addition to our general Terms of Service.

2. Nature of AI-Generated Content

2.1 AI Outputs Are Not Professional Advice

FARMIQ AI OUTPUTS DO NOT CONSTITUTE PROFESSIONAL ADVICE. THE AI ASSISTANT IS NOT A SUBSTITUTE FOR LICENSED VETERINARIANS, AGRONOMISTS, AGRICULTURAL CONSULTANTS, FINANCIAL ADVISORS, OR OTHER QUALIFIED PROFESSIONALS. YOU SHOULD ALWAYS CONSULT WITH APPROPRIATE PROFESSIONALS BEFORE MAKING DECISIONS THAT COULD AFFECT ANIMAL HEALTH, CROP MANAGEMENT, FINANCES, OR LEGAL MATTERS.

2.2 Accuracy and Reliability

AI-generated content may be incomplete, inaccurate, outdated, or inappropriate for your specific situation. FarmIQ uses large language models and retrieval systems that:

• May produce responses that sound plausible but are factually incorrect ("hallucinations").
• May not reflect the most current research, regulations, or best practices in agriculture or animal husbandry.
• Cannot account for all variables specific to your farm, region, climate, soil conditions, or local regulations.
• May provide general information that does not apply to your specific species, breeds, or crop varieties.

2.3 Your Responsibility to Verify

You are solely responsible for evaluating and verifying any AI-generated content before acting upon it. FarmSentry strongly recommends that you independently verify all information, especially regarding:

• Animal health, medication dosages, withdrawal periods, and veterinary treatments.
• Pesticide, herbicide, and fertilizer application rates and safety intervals.
• Breeding decisions, genetic recommendations, and herd management strategies.
• Financial projections, cost estimates, and business decisions.
• Compliance with local, state, national, or international regulations.

3. Prohibited Uses of AI Services

In addition to the prohibited uses outlined in our general Terms of Service, you agree NOT to use FarmIQ AI Services to:

3.1 Harmful Content Generation

• Generate content that promotes animal cruelty, neglect, or abuse.
• Create instructions for producing illegal substances, poisons, or weapons.
• Develop content intended to deceive, defraud, or mislead others.
• Generate spam, phishing content, or malicious communications.
• Create content that violates any applicable laws or regulations.

3.2 Misrepresentation

• Represent AI-generated content as professional veterinary, medical, legal, or financial advice.
• Claim that AI outputs are guaranteed to be accurate, complete, or suitable for any particular purpose.
• Represent AI-generated content as human-generated when it is not, in contexts where such distinction matters.
• Use AI outputs to create false certifications, compliance documents, or official records.

3.3 System Abuse

• Attempt to extract, reverse-engineer, or replicate the underlying AI models or training data.
• Use automated systems to generate excessive requests or abuse rate limits.
• Attempt to "jailbreak" or circumvent AI safety measures and content filters.
• Upload malicious documents designed to exploit document processing systems.
• Use the service to train competing AI models or services.

3.4 High-Risk Decisions Without Human Oversight

• Make autonomous decisions affecting animal welfare without qualified human review.
• Automate critical farm operations solely based on AI recommendations without human verification.
• Use AI outputs as the sole basis for emergency veterinary or crop disease decisions.

4. Content Ownership and Rights

4.1 Your Input Content

"Input" refers to any text, queries, documents, images, or other content you provide to FarmIQ AI Services. You retain all ownership rights to your Input. By submitting Input, you grant FarmSentry a limited, non-exclusive license to process your Input solely for the purpose of providing the AI Services to you.

4.2 AI Output Content

"Output" refers to the responses, suggestions, and content generated by FarmIQ in response to your Input. Subject to your compliance with these Terms:

• FarmSentry assigns to you all rights, title, and interest in the Output generated specifically for you.
• You may use Output for your personal or business purposes related to farm management.
• Output may not be unique to you—similar inputs from other users may produce similar or identical outputs.

4.3 Uploaded Documents

Documents you upload for processing remain your property. By uploading documents, you:

• Represent that you have the right to upload and process such documents.
• Grant FarmSentry permission to process, chunk, embed, and store document content for retrieval purposes.
• Understand that processed document content may be used to provide AI responses to your queries.
• Acknowledge that document processing is subject to the quotas and limits of your subscription plan.

4.4 No Copyright in Pure AI Output

You acknowledge that purely AI-generated content may not be eligible for copyright protection under applicable law. The U.S. Copyright Office and other jurisdictions generally require human authorship for copyright protection. AI-assisted works where you make substantial creative contributions may be protectable to the extent of your human contribution.

5. Data Usage and AI Training

5.1 How We Use Your Data

Your conversations, queries, and uploaded documents are processed to provide AI Services to you. Specifically:

• Conversation Data: Stored to maintain conversation history and context within your account.
• Document Content: Processed into vector embeddings for semantic search and retrieval.
• Farm Context: Accessed in real-time (with your permission) to provide personalized responses.
• Usage Patterns: Analyzed in aggregate to improve service quality and performance.

5.2 Third-Party AI Providers

FarmIQ uses third-party AI services to provide its functionality:

• OpenAI: For generating text embeddings (text-embedding-3-small model).
• OpenRouter / Google: For language model responses (Gemini 2.0 Flash).

Your queries and content may be transmitted to these third-party providers for processing. These providers have their own terms of service and privacy policies. We select providers that commit to not using customer data to train their models, but we cannot guarantee their practices.

5.3 AI Model Training

FarmSentry does not use your individual farm data, personal conversations, or uploaded documents to train AI models. We may use aggregated, anonymized usage patterns to improve our service, but your specific content remains private to your account.

6. Service Limitations and Availability

6.1 Usage Quotas

AI Services are subject to usage limits based on your subscription plan:

• Document upload limits (number of documents and total storage).
• Chat message rate limits to ensure fair usage across all users.
• Document processing size limits (maximum file size and character count).

6.2 Service Availability

AI Services depend on third-party providers and may be subject to:

• Temporary unavailability due to maintenance, updates, or provider outages.
• Changes in functionality as we update or improve the service.
• Discontinuation of specific features with reasonable notice.

6.3 Content Filtering

FarmIQ includes content safety measures that may refuse to process certain requests or generate certain types of content. These filters are designed to prevent harmful outputs and ensure compliance with applicable laws and ethical guidelines.

7. Disclaimer of Warranties for AI Services

IN ADDITION TO THE DISCLAIMERS IN OUR GENERAL TERMS OF SERVICE, THE FOLLOWING APPLY SPECIFICALLY TO AI SERVICES:

FARMIQ AI SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. FARMSENTRY EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO:

• ANY WARRANTY THAT AI OUTPUTS WILL BE ACCURATE, COMPLETE, CURRENT, RELIABLE, OR ERROR-FREE.
• ANY WARRANTY THAT AI OUTPUTS WILL BE SUITABLE FOR ANY PARTICULAR PURPOSE, INCLUDING BUT NOT LIMITED TO VETERINARY CARE, CROP MANAGEMENT, FINANCIAL DECISIONS, OR REGULATORY COMPLIANCE.
• ANY WARRANTY THAT AI SERVICES WILL BE UNINTERRUPTED, TIMELY, OR SECURE.
• ANY WARRANTY REGARDING THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF AI SERVICES.
• ANY WARRANTY THAT AI OUTPUTS WILL NOT INFRINGE THIRD-PARTY RIGHTS.

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF AI SERVICES IS AT YOUR SOLE RISK. FARMSENTRY DOES NOT WARRANT THAT AI OUTPUTS WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.

8. Limitation of Liability for AI Services

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

FARMSENTRY, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, AND DIRECTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF AI SERVICES, INCLUDING BUT NOT LIMITED TO:

• LOSS OR INJURY TO LIVESTOCK, CROPS, OR OTHER FARM ASSETS.
• VETERINARY COSTS, TREATMENT EXPENSES, OR ANIMAL MORTALITY.
• CROP FAILURES, REDUCED YIELDS, OR AGRICULTURAL LOSSES.
• FINANCIAL LOSSES, LOST PROFITS, OR BUSINESS INTERRUPTION.
• REGULATORY FINES, PENALTIES, OR COMPLIANCE COSTS.
• ANY DAMAGES RESULTING FROM RELIANCE ON AI-GENERATED CONTENT.

THIS LIMITATION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF FARMSENTRY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

IN NO EVENT SHALL FARMSENTRY'S AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO AI SERVICES EXCEED THE GREATER OF (A) $100 USD OR (B) THE AMOUNT YOU PAID TO FARMSENTRY FOR AI SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Indemnification for AI Services

You agree to indemnify, defend, and hold harmless FarmSentry and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including reasonable attorneys' fees, arising from or relating to:

• Your use or misuse of AI Services.
• Your reliance on AI-generated content for any purpose.
• Any decisions or actions you take based on AI outputs.
• Your violation of these AI Services Terms.
• Your violation of any third-party rights, including intellectual property rights.
• Any content you input, upload, or submit to AI Services.
• Any claim that your use of AI outputs caused harm to any person or entity.

10. Specific Disclaimers by Use Case

10.1 Animal Health and Veterinary Matters

FarmIQ is NOT a veterinary service. Any information provided about animal health, disease diagnosis, treatment protocols, medication dosages, or veterinary care is for informational purposes only and MUST NOT be used as a substitute for professional veterinary advice, diagnosis, or treatment. Always seek the advice of a qualified veterinarian for any questions regarding animal health.

10.2 Crop and Agricultural Advice

Agricultural recommendations from FarmIQ are general in nature and may not account for your specific soil conditions, climate, local pest pressures, or regulatory requirements.
